Terms
The main terms for 385-design: pricing, duration, payment, cancellation, transfer and ownership. They apply to businesses, self-employed customers and private customers.

1. Who provides the service
385-design is a service by SE-Optimizz BV, trading as WE-Optimizz®, Koning Boudewijnlaan 20a, 3500 Hasselt, Belgium. Company number 1002.993.460, VAT BE1002 993 460. Email: barry@we-optimizz.com, phone: +32 472 49 07 05.
2. What you get
The starter package includes a website with up to four pages, a mobile-friendly design, hosting, technical maintenance and technical SEO essentials. Choose additional pages and features (blog, online store, bookings, CMS, additional language) in the calculator. The exact scope is set out in your personal proposal.
3. Request and proposal
A request through the website is non-binding and is not an order. A contract is only formed once you accept our proposal. The proposal and price may differ from the indicative price in the calculator.
4. Pricing
- Prices for businesses and self-employed customers are excluding VAT. For private customers, we display and charge the price including 21% VAT.
- Prices are expressed per day. You pay a fixed monthly amount: the daily price x 365 divided by 12.
- There are no setup fees.
5. Duration
The contract has a term of 36 months. It starts on the day your website is delivered.
6. Payment
You pay monthly by direct debit. Invoices are sent by email. The first invoice must be paid before delivery.
7. Cancellation and transfer
You can cancel at the end of a month, via barry@we-optimizz.com. The remaining months of the 36-month term are invoiced in one payment. The contract continues until that invoice is paid.
Once the invoice is paid, we transfer everything you need to continue independently with your website.
For example, if you cancel after 6 months, you receive an invoice for the remaining 30 months. Once that invoice is paid, the website is yours.
8. Right of withdrawal for private customers
If you are a private customer, you may withdraw from the contract within 14 days of entering into it without giving a reason. Send a clear notice to barry@we-optimizz.com. If you expressly asked us to start within those 14 days, you pay a proportionate amount for the work already carried out if you withdraw.
9. Ownership of text and images
Text, images, logos and other materials you provide remain your property. You grant us the right to use that material to build and maintain your website.
10. Timing
Delivery takes approximately two weeks after the start, once all required information is complete. We start a new website approximately every 3 days. When demand is high, we use a waiting list; we will let you know when a slot is available.
11. Liability
We are liable for damage directly resulting from a failure in our service. Our liability is limited to the amount you paid us in the 12 months preceding the incident. Business customers cannot claim compensation for indirect damage, such as lost profit. These limitations do not apply in cases of intent, fraud or gross negligence, or to liability that cannot legally be limited or excluded.

These terms are governed by Belgian law. For business customers, the courts of the judicial district of Limburg, Hasselt division, have jurisdiction. For private customers, the court designated by law has jurisdiction.
